Prenuptial and postnuptial agreements · Wyoming contract law

A Wyoming prenup is a contract, and it is enforced like one.

Wyoming never adopted the Uniform Premarital Agreement Act. What governs prenups is the Supreme Court, which has held for decades that premarital agreements "are valid and enforceable in Wyoming" and are read like any other contract. A court will enforce the document you signed, not the one you meant to sign, and will not add a term you left out. I draft and negotiate these agreements for one of you, never both, and I write them to survive the attack a divorce lawyer will make on them years later.

Can, cannot, and what makes it hold.

Money, yes.

Define what stays separate and what becomes marital, including growth in a business; settle gifts and inheritances; fix, cap or waive alimony; waive the surviving spouse's elective share "after fair disclosure" (W.S. § 2-5-102). Enforced exactly as written (Morrison v. Hinson-Morrison, 2024).

Children, no.

Custody and support clauses were struck: a parent cannot contract away "the rights of the child to seek adequate support" (Combs, 1993). Custody is decided at divorce (W.S. § 20-2-201); agreed support is tested against the guideline (W.S. § 20-2-307(d)).

Knowledge and willingness.

Duress, fraud, unconscionability, unclear language: the defenses of any contract. Courts have enforced agreements signed the day before the wedding (Lund, 1993), three days before in Teton County (Seherr-Thoss, 2006), and on the wedding morning (Morrison, 2024), each on a record of knowledge and willingness.

Who signs one here, and when.

Land, second marriages, and the company

Teton County prenups are often about family land: the ranch, the parcel under easement, the partnership holding both. In the marriage it is the owner's alone (W.S. § 20-1-201); at divorce it goes before the judge, and its appreciation, marital improvements, and a spouse's labor become arguments a prenup settles. A second marriage needs the elective share waived and the children's inheritance protected (prenups in second marriages). A company started before the wedding is separate; its growth may not be (prenups and business ownership).

A prenup, in orderBefore the wedding
  • 01Three months out: the first meeting, a written inventory of what each of you owns, owes and expects to inherit, and the conversation with your fiancé
  • 02Ten weeks out: each of you retains your own lawyer; I represent one of you, never both
  • 03Eight weeks out: disclosure schedules exchanged, with statements, returns, entity documents and any appraisals attached
  • 04Six weeks out: first draft, then negotiation between counsel; every change initialed
  • 05At least two weeks out: signed and notarized, each of you with your lawyer, schedules attached, originals kept by both
  • 06After the wedding: accounts kept the way the agreement says, and the document revisited when a business, a child or an inheritance arrives

The calendar is mine, not a statute's. Wyoming sets no minimum number of days, and the Supreme Court has enforced agreements signed the day before a wedding. The point of the schedule is the record it leaves. The timeline post walks through each step.

Set the wedding date, then call. The record takes three months to build well.

Trusts and second marriages, four corners, the sentences a prenup needs, postnups

Trust interests, and the second marriage in detail

Trust interests need the same care as land. A right to distributions, a remainder that vests on a parent's death, and distributions already received are three different things, and the agreement should treat each, because a court may reach one and not another. A spouse marrying again with children from the first marriage has two sets of obligations that will collide without a document. Wyoming gives a surviving spouse the right to elect a share of the estate regardless of the will, one-half or one-fourth depending on whether the survivor is a parent of the decedent's children, and gives a divorcing spouse a claim on property acquired during the marriage regardless of whom it was meant for. A prenup can waive the elective share, designate what passes to the children, and keep the retirement accounts and the house from the first marriage on their own side of the ledger. It has to be coordinated with the will and the beneficiary designations, or the agreement will say one thing and the paperwork another. The owner's spouse has a claim on a company's marital-years growth that can only be paid by buying them out, borrowing against the company, or selling it; the valuation fight the agreement avoids is described on the high-net-worth page.

Read like a contract

When the language is clear the court looks only to the four corners of the document, and "where a contract is silent on a particular matter that easily could have been drafted into it, a court should refrain from supplying the missing language under the pretext of contract interpretation." That sentence, quoted by the Supreme Court in Morrison, is why the husband in that case could not persuade the court to infer a commingling rule the agreement did not contain, and why a prenup has to anticipate what married people actually do: buy a house together with separate money, deposit an inheritance in the joint account, put a spouse on the family company's payroll. Each needs a sentence. The agreement also needs an alimony clause that says what it means, a debt clause, a choice of governing law in case you move, and disclosure schedules stapled to it, because the argument that a spouse did not know what she was signing is answered by the list of what she was shown. The Combs court, which called the custody clause "void as against public policy," also struck a clause that tried to keep the divorce out of court. Lifestyle clauses and penalties for conduct are the terms a court is least likely to enforce, and the ones most likely to color how it reads the rest. The post on what makes a prenup invalid collects the ways these agreements fail.

Postnuptial agreements

A postnuptial agreement does the same work after the wedding, with one added requirement. A prenup is supported by the marriage itself; once you are married, the Supreme Court has held, "the existing marital relationship cannot provide adequate consideration," and there must be "an exchange of other identifiable consideration" for the agreement to bind (Combs, 1993). In practice each spouse gives something: a transfer of property, a release of a claim on the business, a funded account in the other's name. Wyoming lets married people contract with each other as if unmarried (W.S. § 20-1-202(a)), and the occasions are ordinary: a company founded in year five, an inheritance in year ten, a prenup signed in a hurry that both spouses would rather replace, or a reconciliation both want to protect. The limits are the same as before the wedding: nothing about the children, nothing that ousts the court, nothing a judge would refuse to enforce as a contract.

Two practical notes

Nothing requires a prenup to be filed anywhere, so keep signed originals in two places and give your estate-planning documents a copy. And an agreement is only as good as the conduct that follows it: a separate account that becomes the household account, or a "separate" ranch whose mortgage is paid from joint funds for fifteen years, hands the other side its strongest argument. The division of assets page shows how a court traces money when the agreement and the bank statements disagree; the alimony page shows what a waiver is worth. I represent one of you, and I say so at the first meeting; your fiancé should have a lawyer of their own.

Asked about Wyoming prenups.

Is a prenup enforceable in Wyoming?
Yes. The Wyoming Supreme Court has said since at least 1979 that antenuptial agreements are valid and enforceable and read like any other contract, repeated in 1993, 2006 and 2024. A trial court must enforce one unless the record supplies a cogent reason not to. The attacks are those on any contract: duress, fraud or concealment, a term that is unconscionable or against public policy, or language that does not say what one side now wishes it said. An agreement drafted with those attacks in mind survives them.
Does Wyoming follow the Uniform Premarital Agreement Act?
No. Wyoming never adopted the uniform act, and its domestic-relations title has no premarital-agreement section at all. That surprises people who have read about the act elsewhere, including in older material of my own. No statute does not mean a weaker prenup; the agreement lives under contract law and the Supreme Court’s decisions. The elements those decisions look for, a voluntary signature, knowledge of what is being given up, and terms a court can apply as written, are what a careful drafting process is built to prove.
Can a prenup decide custody or child support?
No, and a clause that tries will be struck. The Supreme Court held in 1993 that a clause awarding custody to one parent was void as against public policy, because custody is decided on best interests at the divorce, and a child-support cap void because “a parent is prohibited from contracting away the rights of the child to seek adequate support.” The child support statute independently requires the court to test any agreed amount against the presumptive guideline. Property and alimony are yours to contract about; the children are not.
Can we sign a prenup the week before the wedding?
You can; Wyoming courts have enforced agreements signed a day before, three days before, and on the wedding morning. That is not a recommendation. Timing is the first thing a challenging spouse reaches for; a signature under the pressure of a booked venue and arriving guests is the easiest duress story. Late agreements were enforced because the record showed the signer understood and signed willingly. If the wedding is close, the cure is disclosure attached, a lawyer each, and a documented signing. Otherwise a postnup may be the better instrument.
Can a prenup waive alimony?
Yes. Alimony is discretionary and belongs to the spouses; an agreement can waive it, cap it, or tie it to the length of the marriage. Waivers are enforced as written; a spouse who signed with full disclosure and a lawyer will struggle to undo one. A waiver leaving one spouse with nothing after a long marriage invites an unconscionability argument, so better agreements scale with the years. And it should say whether it covers temporary support and fees during the divorce, which a court can order under another statute.
Is a postnuptial agreement valid in Wyoming?
Yes, but it needs something a prenup does not. For a prenup the marriage itself is the consideration; once married that is gone, and the Supreme Court holds “in a postnuptial agreement, the existing marital relationship cannot provide adequate consideration,” so there must be an exchange of something else: property, a release of a claim, a promise that costs something. An agreement that only restates what one spouse has, signed by the other for nothing, will not hold. Otherwise the same rules apply: disclosure, separate lawyers, nothing about the children.
